Indemnification and Relationship Disclaimer: Client agrees to indemnify and hold Tech-Check, its officers, employees, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to services provided by any referred party. Any relationship, contract, agreement, or transaction between Client and a referred service provider constitutes an independent relationship to which Tech-Check is not a party. Tech-Check assumes no responsibility for negotiations, contracts, agreements, or transactions between Client and any referred service provider, and Client acknowledges that any such matters are exclusively between Client and the service provider.
16. Property Access and Authority
Client represents and warrants that they have legal authority to authorize the inspection of the property and all its systems. Client shall:

Inform occupants of the scheduled inspection

Provide lawful access to all relevant systems

Disclose any access restrictions or limitations
Tech-Check assumes no responsibility for unauthorized access or inspections performed without proper authority. Client agrees to indemnify and hold Tech-Check harmless from any claims arising from unauthorized property access.
17. Inspection Termination
Tech-Check reserves the right to immediately terminate any inspection if, in our sole professional judgment, any of the following conditions are encountered:

Criminal activity or evidence thereof

Hostile or threatening behavior

Environmental hazards
-
Unsanitary conditions

Restricted or denied access

Any condition that compromises inspector safety

Any circumstance that prevents proper inspection
In the event of inspection termination due to such circumstances:

No refund will be issued

A partial report may be provided for completed portions

Tech-Check maintains the right to report illegal activities to authorities

The Client agrees that Tech-Check Home Technology Inspections' liability for any claims, damages, losses, costs, and expenses arising out of or relating to our services, including claims of professional negligence, is strictly limited to the fee paid for our inspection services. In no event shall Tech-Check be liable for any special, indirect, exemplary, punitive, or consequential damages of any kind, including but not limited to loss of use, loss of income, loss of time, loss of savings, loss of data, costs of repairs or replacement, or any similar damages, whether based in contract, tort, strict liability or otherwise.
The Client agrees to indemnify, defend, and hold harmless Tech-Check Home Technology Inspections, its owners, employees, agents, and representatives from and against any and all claims, demands, actions, causes of action, losses, damages, lawsuits, costs, and expenses (including reasonable attorney fees and court costs), arising from or relating to: (a) services provided by Tech-Check; (b) Client's use of the inspection report; (c) third-party use or reliance on the inspection report; (d) any repairs, improvements, or modifications made based on our findings; or (e) any property damage or personal injury related to our inspection services.
The Client acknowledges that the inspection fee paid to Tech-Check Home Technology Inspections is nominal relative to the potential liability associated with home technology systems, and that a more detailed and expensive inspection may be available from other providers. In recognition of this risk allocation, the Client agrees that this limitation of liability is a material part of our agreement and that Tech-Check would not provide these services without such protection.
